1. Acceptance
By accessing this website or using an AREACODEZERO service, you agree to these Terms of Service. If you are acting for an organisation, you confirm that you have authority to bind it. If you do not agree, do not use the website or services.
2. Our services
Service scope, deliverables, timelines, prices, payment terms, support levels and acceptance criteria are confirmed in the applicable quotation, order, statement of work or agreement. Website information is general and does not create an offer unless expressly stated in writing.
3. Customer responsibilities
You must provide accurate information, lawful instructions, timely access and approvals, and any content, credentials, licences or materials needed for delivery. You are responsible for authorising us to work on systems and for maintaining backups of data you provide unless a written agreement says otherwise.
4. Acceptable use
You must not use our website, systems or services for unlawful activity, fraud, harassment, malware, unauthorised access, infringement, spam or any activity that could damage our systems or other users. We may suspend access where necessary to protect the service or comply with law.
5. Payments, orders and third parties
Prices and payment timing are as stated in the applicable quotation or checkout. Orders may be subject to availability and verification. Payment providers, hosting companies, domain registrars and other third parties operate under their own terms; we are not responsible for interruptions or acts outside our reasonable control.
6. Intellectual property
Our website, software, designs, documentation, trademarks and original materials remain our property or that of our licensors. You retain rights to materials you provide. Rights in paid-for deliverables transfer or are licensed only as stated in the applicable written agreement and after required payment.
7. Confidentiality and data
Each party must protect confidential information received from the other and use it only for the agreed purpose. Personal information is handled under our Privacy Policy and, where relevant, our Data Protection & GDPR page.
8. Warranties and liability
We will perform agreed services with reasonable skill and care. Except where the law does not permit limitation, we exclude implied warranties and are not liable for indirect, incidental, special or consequential loss, loss of profit, loss of data or business interruption. Our aggregate liability for a claim is limited to the fees paid for the affected service during the applicable period, subject to the written agreement and applicable law.
9. Suspension and termination
Either party may end a service in accordance with the applicable agreement. We may suspend or terminate access for non-payment, material breach, unlawful use or security risk. Amounts accrued before termination remain payable.
10. Changes and governing law
We may update these terms when our services or legal obligations change. The updated version takes effect when published. Unless a signed agreement states otherwise, these terms are governed by the laws of Kenya and disputes are subject to the courts of Kenya.
